Data Protection

Article 13 of the Swiss Federal Constitution and Swiss data protection laws (DSG) give everyone the right to privacy and protection from the misuse of their personal data. We comply with these provisions. Personal data is treated with the strictest confidence and will not be sold or passed on to third parties.

Working closely with our hosting provider, we endeavour to protect our databases as much as possible from unauthorized access, loss, misuse or falsification. When our websites are accessed, the following data is saved in log files: IP address, date, time, browser request and general information submitted to the operating system and browser, respectively. This usage data forms the basis for anonymous statistical analyses. The provider reserves the right to review the log data later if there are concrete grounds for the justified suspicion of unlawful use.

Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. Google Analytics uses cookies — text files stored on your computer — to analyse website usage. The information generated by the cookie will generally be transferred to and stored on a Google server in the USA. If IP anonymization is activated, your IP address will first be truncated within the EU/EEA before transfer. You may prevent the use of cookies by selecting the appropriate settings in your browser, though this may limit certain website functions.

Facebook & Instagram Plugins

This website integrates plugins from Facebook (Meta Platforms, Inc.) and Instagram (Instagram LLC). When you visit a page containing such plugins, your browser establishes a direct connection to the respective servers, allowing them to record that you visited our site. If you are logged into your account, the visit may be associated with your profile. We receive no knowledge of the data transferred or how it is used.

To prevent association of your visit with your account, please log out of Facebook and Instagram before visiting this website. For further information, refer to the respective privacy policies of Facebook and Instagram.

Cookies

This website uses cookies — small text files stored temporarily or permanently on your computer. Their main purpose is to analyse website usage for statistical evaluation and continuing improvement. You can fully or partially deactivate cookies in your browser settings, though not all website functions may remain available.

Your Rights

You have the right to request, free of charge, what personal information about you has been stored. You also have the right to have incorrect information amended, and to have personal data blocked or deleted, provided there is no legal obligation to retain it. Contact: info@fam-photography.ch

General Terms and Conditions

By engaging Fam Photography, the Customer agrees to these General Terms and Conditions (GTC) and the terms outlined on the Services & Pricing page.

I. Definitions

  • Photographic Work — the result of work performed by the Photographer for the Client in accordance with the agreement.
  • Photographer — the person commissioned with the creation of the Photographic Work (Fam Photography).
  • Customer / Client — the person who commissions the Photographic Work.
  • Copy — any disclosure of the Photographic Work in analogue or digital form on a carrier or online.

II. Performance of the Photographic Work

  1. Unless agreed otherwise in writing, the artistic and technical configuration of the Photographic Work is fully at the Photographer's discretion.
  2. The Photographer may engage auxiliary staff of their choosing.
  3. Shooting equipment is provided by the Photographer.
  4. The Client is responsible for ensuring that locations, objects and persons are available in due time.
  5. If a session is postponed less than two days before the appointment, the Photographer is entitled to reimbursement of costs and compensation of 50% of the session fee.
  6. The same applies to postponement due to adverse weather conditions less than two days before the shoot.
  7. Unless agreed otherwise, the fee is not subject to VAT and must be paid within 30 days of invoicing, and in any case 5 working days before the session.

III. Liability of the Photographer

  1. The Photographer bears liability only for intentional or grossly negligent conduct.
  2. The Client must raise any objections relating to a defect in writing within five working days of delivery; otherwise the work is deemed approved.

IV. Use of the Photographic Work by the Client

  1. The Client may only use the Photographic Work for the agreed purpose and period. Breach of agreement obliges the Client to pay 150% of the remuneration owed.
  2. The right to use the Photographic Work is non-transferable unless agreed otherwise in writing.
  3. The Client must credit the Photographer in a suitable form (© Fam Photography). Failure to do so obliges an additional payment of 50% of the applicable fee.
  4. The Client must ensure that persons photographed have given their consent, and that no third-party rights preclude the creation or use of the Photographic Work.

V. Use of the Photographic Work by the Photographer

  1. Copyright remains with the Photographer, who retains the right to use the work for their own purposes (website, portfolio, exhibitions, etc.). If the Client requests exclusivity, the fee is increased by 30%.
  2. Even where copyright is transferred to the Client, the Photographer retains the right to use the work for their own purposes.

VI. References

The Photographer is entitled at any time to refer to the cooperation with the Client and to the Photographic Work, including in publications, at exhibitions, and in discussions with potential clients.

VII. Applicable Law and Jurisdiction
